Welcome to Slumber Avenue. These Terms of Service ("Terms") govern your access to and use of slumberavenue.com (the "Site") and any purchases you make from us. The Site is operated by AFTERSHOCK DIGITAL ("Slumber Avenue", "we", "us", or "our").

By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Eligibility

By using the Site, you confirm that you are at least 18 years of age, or that you are using the Site under the supervision of a parent or guardian. You agree to provide accurate and complete information when placing an order or creating an account.

You agree to notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Products, Descriptions, and Pricing

We make every effort to display our products and their colours, features, and details as accurately as possible. However, we do not warrant that product descriptions, images, or other content are completely accurate, current, or error-free, and actual products may vary slightly from images shown.

All prices are listed in AUD and are subject to change without notice. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information (including pricing and availability) at any time without prior notice.

4. Orders and Acceptance

Your order is an offer to purchase a product. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities, errors in pricing or product information, or suspected fraudulent activity.

A contract for the sale of products is formed only when we send you a confirmation that your order has been dispatched. If we cancel an order after payment has been made, we will issue a full refund of the amount paid for the cancelled items.

5. Payment

Payment must be made in full at the time of placing your order. We accept the payment methods displayed at checkout. By providing payment details, you represent and warrant that you are authorised to use the payment method and authorise us (and our payment processor) to charge the total order amount.

6. Shipping and Delivery

Shipping costs and estimated delivery times are displayed at checkout and in our Shipping Policy. Delivery time frames are estimates only and are not guaranteed. Risk of loss for products passes to you upon delivery to the carrier or to you, as applicable.

7. Returns, Refunds, and Cancellations

Our returns and refunds process is set out in our Refund Policy, which forms part of these Terms. Nothing in our Refund Policy limits or excludes your rights under the Australian Consumer Law (see Section 11).

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, product designs, and the "Slumber Avenue" name and branding, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without our prior written permission.

• For any unlawful purpose or in violation of any applicable laws.
• To transmit harmful code, viruses, or malicious material.

11. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law where to do so would be unlawful. Where we are permitted to limit our liability, our liability is limited (at our option) to the replacement of the products, the supply of equivalent products, or the payment of the cost of replacing the products.

12. Disclaimers

Except as required by law and as set out in Section 11, the Site and all products are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, and subject to Section 11, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the Site or any products purchased from us.

14. Indemnification

You agree to indemnify and hold harmless Slumber Avenue and its owners, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your breach of these Terms or your misuse of the Site, to the extent permitted by law.

15. Governing Law

These Terms are governed by the laws of South Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.
